My brother is adamant that if there is a flush on the board that is Ace high that it is the highest rank possible (which i know) and he says that then it is a split pot. But im telling him that it isnt, if you all have what is on the board then you go by your two cards. Whoever has the highest out your own two is the winner. This is texas holdem by the way. Thanks

The 3rd guy would win because he has a higher heart which affects the flush. His flush would be Ah Jh Th 7h 4h, whereas the other players have Ah Th 7h 4h 3h. Which is lower obviously.
If this wasnt the case and noone had a heart, (or the only played that had a heart had the 2 of hearts.) then it would just be split pot.
In Texas Hold'em it is the best hand of FIVE CARDS. So it will not then be split to whoever has the highest 2 hole cards (Eg AK without K as a heart) since that would make it a 6 or 7 card hand. You follow?
